Life sentence for fatal assault on girlfriend

Platinum Weekly newspaper | Mogwase – A brutal assault that claimed a woman’s life in Makoshong Village has resulted in a life sentence for her boyfriend, 38-year-old Benjamin Moya.
In a statement issued on 12 October 2026, National Prosecuting Authority (NPA) communication officer Lindiwe Mabasa confirmed that the Mogwase Regional Court sentenced Moya for the murder, which took place on 25 May 2025.
The court heard that Moya visited his girlfriend that evening and found her with a male friend, who fled when he became aware of Moya’s presence.
Moya assaulted her with his fists, booted feet, a sjambok and a builder’s spirit level. He then instructed her to accompany him to the home of another woman with whom he was romantically involved, saying he regarded both women as his wives and wanted an explanation.
The assault continued along the way. After they arrived, Moya wanted both women to accompany him to the wife of his best friend, whom he allegedly believed he had found with the deceased. However, it became apparent that his girlfriend was seriously injured and bleeding. She was rushed for medical attention but was declared dead that same day.
Moya pleaded guilty to murder. The court also heard that he had been released on bail on 15 January 2026 and remained on bail until the matter was finalised.
Arguing for the prescribed minimum sentence, state prosecutor Joseph Makwe highlighted the prevalence of gender-based violence and submitted that there were no substantial and compelling circumstances justifying a lesser sentence. The court agreed, sentencing Moya to life imprisonment and declaring him unfit to possess a firearm.
The director of public prosecutions welcomed the outcome and commended Makwe and SAPS sergeant Unathi Tiem for their work in securing justice. The NPA reaffirmed its commitment to combating gender-based violence and holding perpetrators accountable.
